Privacy Policy

General Provisions 

This Privacy Policy (hereinafter referred to as Policy) of the internet service available at https://popeyes.kz/  (hereinafter referred to as Service) applies to the information transferred by users (hereinafter referred to as Users) of the website https://popeyes.kz/ during the use by Users to the Limited Liability Partnership Central Brands (hereinafter referred to as Administrator) as well as to affiliated persons of Administrator.

When Users use the Service, as well as when paying for and using the products and services of the Service, when conducting surveys on the Service, Administrator may request the following information from the User:

1 Surname, first name, patronymic of User;

2 E-mail address;

3 Year of birth;

4 Sex;

5 Information about quantity, cost, time and procedure of the orders made by Users for goods or services of the Service;

6 Information about participation in promotions of the Service;

7 Information about subscription to information materials or materials of the Service support;

8 Information about User`s geo-position in the Service`s services;

9. Information that is automatically transferred to Administrator in the process of using the Service with the help of the software installed on the User`s device, including IP-address, cookies information, information about country and (or) city of location of the User, information about User`s Internet browser (or other program with the help of which the Service is accessed), access time, address of the requested Page, about the Userzs device with the help of which the Service is accessed.

This Privacy Policy is applied only to the Service. By giving consent, the User acts of his/her own free will and in his/her own interest. Administrator does not control and is not responsible for third-party websites and software to which the User can have access through the links available on the Service. On other third-party websites, other information may be collected or requested from the User, as well as other actions may be performed for which the Administrator is not responsible. Administrator does not check reliability of the information and does not take charge of its efficiency. However, Administrator assumes that the User submits true and sufficient information and keeps this information up to date, upon verification and subsequent use.

Terms and Definitions

The following terms and definitions are used in this Policy:

1. Personal data is information related to an identified or identifiable on their basis subject of personal data, recorded on electronic, paper and (or) other material medium.

2. Non-personal data is information that is automatically transmitted in the process of viewing advertising blocks by the User and when visiting pages on which the statistical script of the system is installed: address of the requested page, cookies information, IP-address, browser information, referrer (address of the previous page), access time.

3. Collection of personal data means actions aimed at obtaining personal data.

4. Personal data processing means actions aimed at accumulation, storage, modification, amendment, addition, use, distribution, anonymization, blocking and destruction of personal data.

5. Personal data security s a set of legal, organizational and technical measures carried out for the purposes established by the Law of the Republic of Kazakhstan “On Personal Data and Their Protection”.

6. Service is a website located on a server in Almaty and available at https://popeyes.kz/, which presents goods and services offered to Users for placing orders, as well as payment terms and conditions and delivery/service of these orders to Users.

7. Administrator is Central Brands LLP, which is the owner of the Service; Certificate of state re-registration of a legal entity issued by the Registration Office of Real Estate Titles and Legal Entities of the branch of the non-profit joint stock company “State Corporation “Government for Citizens” for the city of Almaty dated 10/02/2023, BIN 221140042105.

8. Cookies are small text files in which the browser records data from websites visited by Users. Cookies perform a number of functions, such as allowing the User to navigate efficiently between pages by memorizing his/her preferences, thus improving experience of interacting with the Service. They may also help to ensure that advertisements the User sees online are relevant to his/her interests.

9. IP-address is a unique network node address for cyberspace built on the IP protocol, allowing to determine the location of the User. The Service does not track location, more detailed than city and region.

Objectives of Information Collection and Processing 

Administrator uses the information solely for the purpose of providing the services offered by the Service and improving their quality, as well as to make the services and content of the Service easier and more convenient to use, including for as follows:

1. identification of the User within the framework of provision of services by the Service;

2. to provide the User with personalized and recommended services of the Service;

3. to provide the Service, Apps and services to the User;

4. conducting our business; communicating with you; managing our IT-systems;

5. conducting surveys;

6. compliance with the current legislation;

7. recruiting and review of job applications;

8. personalization of displaying promotional materials to the User of the Service;

9. to receive and process payments from Users;

10. to process Users` requests by the Service Administrator or the Service support;

11. for analysis and research to improve the Service and the Service`s goods and services;

12. to send news and advertising information about products, services, promotions, special offers of the Service;

13. to send service messages, notifications, requests and information regarding the use of the Services, provision of services, as well as to process requests and applications from Users;

14. to prevent and detect fraud and illegal use of the Service, services of the Service;

15. to conduct statistical and other research on the basis of anonymized data

Information Processing Conditions

Administrator uses the information of Users only for the purposes and in accordance with this Policy.

The User`s information shall be kept confidential.

Administrator shall not disclose to third parties, distribute, sell, dispose of or otherwise manage the information received, except for the purposes and in the ways provided for in this Policy.

Administrator has the right to transfer the User`s personal data without User`s consent to state authorities of the Republic of Kazakhstan, including inquiry and investigation authorities, only upon their reasoned request, as well as judicial authorities, if necessary in connection with legal proceedings.

Administrator may share certain anonymized information (data that does not allow to identify Users individually) with third-party service providers, trusted partners or authorized researchers in order to better understand what advertising or services may be of interest to Users, improve the overall quality and efficiency of the Service.

While processing Users` information, Administrator shall be guided by the current legislation of the Republic of Kazakhstan.

Changing or Deleting Information from the Service

User may at any time change (update, supplement) the information submitted by him or its part by contacting the Service support.

Protection of Users` Information 

Administrator ensures that necessary and sufficient organizational and technical measures are taken to protect Users` information from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.

Policy Amendment. User Consent with the Policy

User acknowledges and agrees that User`s use of the Service and any of its services and functionality means the User`s unconditional agreement with all the clauses of this Policy and unconditional acceptance of its terms.

User`s continued use of the Service after any amendments to the Policy means his/her consent to such amendments and/or supplements.

User undertakes to familiarize himself/herself with the contents of this Policy on a regular basis in order to familiarize himself/herself timely with its changes available at web address: https://popeyes.kz/ 

Administrator reserves the right to unilaterally change this Privacy Policy to further improve the security system in accordance with the current legislation of the Republic of Kazakhstan.

Final Provisions

The law of the Republic of Kazakhstan shall apply to this Policy and relations between Users and Administrator arising in connection with the application of the Policy.

All possible disputes arising from this Policy shall be resolved in accordance with the applicable law at the place of registration of Administrator.
Before appealing to the court, User shall comply with the obligatory pre-trial procedure and send Administrator a corresponding claim in writing. The period of response to the claim is 15 (fifteen) working days.

This Policy is available to all Users of the Service without exception.
